Terms of Service

PLEASE READ THE FOLLOWING TERMS AND CONDITIONS OF SERVICE FOR THIS WEBSITE BEFORE USING THIS SITE.

By continuing to access, link to, or use this Site, or any Service on this Site, Users are signifying their ACCEPTANCE OF FRONT PAGE.ORG’S TERMS OF SERVICE. Please see Section II.B of the Terms of Service, User Acceptance of the TOS and Any Modifications Thereto, for more information.  

1. Definitions

  • “Front Page” is Front Page.org, its agents, directors, officers, employees, representatives, successors, and assigns. Front Page owns and operates the Front Page.org website, accessible at http://frontpage.org.
  • “TOS” is the Site’s Terms and Conditions of Service, accessible at ____________.
  • “Services” refers to the features, functionality, and content of the Site.
  • “Content” is information, materials, and other content accessible on or through the Site or via the Services, including, but not limited to, video, sounds, text, images, and designs.
  • “User” refers to any internet Visitor or User of the Site, namely a person that seeks to use and engage with the Content or Services.
  • “Third Parties” means any person or entity that is not Front Page.
  • “Intellectual Property Rights” means all present and future rights to trade secrets, patents, copyrights, trademarks, service marks, know-how, and other proprietary rights of any type under the laws of any governmental authority, domestic or foreign, including rights to all applications and registrations relating to the Site, Content, or Services

 

2. General Terms

  • Users’ Authority to Agree to this TOS

Users represent, warrant, and covenant that they have the power and authority to enter into this agreement and that they are at least eighteen (18) years of age.

  • User Acceptance of the TOS and Any Modifications Thereto

By continuing to access, link to, or use the Site, Content, or Services, Users represent that they have read and agree to be bound by the TOS.

Front Page.org reserves the right to amend, remove, or add to this Terms of Service at any time. Such modifications shall be effective immediately. By continuing to access, link to, or use the Site, Content, or Services after modifications to the TOS have been posted, Users signify their Acceptance of the TOS, as modified. While Front Page may notify Users of changes to the TOS via email, account messaging, or Site banners, it is the Users’ responsibility to read the TOS and ensure they understand and abide by its terms. Accordingly, please continue to review the TOS whenever accessing, linking to, or using the Site, Content, or Services.

If, at any time, a User does not wish to accept or continue to accept the TOS, the User may not access, link to, or use the Site, Content, or Services. Additionally, the User must dispose of any Content in the User’s possession pursuant to Section II.C, Termination, below.

Any terms and conditions proposed by a User which are in addition to or which conflict with the TOS are expressly rejected by Front Page.org and shall be of no force or effect.

  • Termination

Users may terminate the TOS, with or without cause, at any time by discontinuing their use of the Site, Content, and Services and destroying all materials obtained therefrom.

Users agree that Front Page may terminate the TOS, or suspend Users’ access to the Site, Content, and Services, without notice and with or without cause, at any time, and effective immediately. The TOS will terminate immediately, without notice from Front Page, if a User, in Front Page’s sole discretion, fails to comply with any provision of the TOS. Front Page shall not be liable to Users or to any Third Parties for the termination or suspension of the Site, Content, or Services, or for any claims related thereto.

Upon termination of the TOS, Users must discontinue their use of the Site, Content, and Services and promptly destroy all materials obtained from the Site, Content, or Services along with any copies thereof.

  • Restrictions on Use of Site, Content, and Services

Users may not use the Site, Content, and Services for any illegal purpose; to violate, or facilitate the violation of, any law or regulation; or in any manner inconsistent with the TOS. Users may not disrupt, interfere with, or attempt to disrupt or interfere with the proper working of the Site, Content, or Services, or any servers or networks connected to the Site, Content, or Services. Users may not obtain, nor attempt to obtain, any Content that Front Page has not intentionally made publicly available, either by public display on the Site or via a visible link on the Site. Users shall not violate the security of the Site or attempt to gain unauthorized access to the Site, Content, or Services through hacking, password timing, or by any other means. Users may not take or attempt any action that, in Front Page’s sole discretion, imposes or may impose an unreasonable or disproportionately large load or burden on the Site, Content, Services, or any related technology or infrastructure. Users shall not use or attempt to use any “scraper,” “robot,” “bot,” “spider,” “data mining,” “computer code,” or any other automated device, program, tool, algorithm, process, or methodology to access, acquire, copy, or monitor any portion of the Site, Content, or Services without prior express written consent from Front Page.

  • Acknowledgment of Intellectual Property Rights

The Site, Content, and Services are protected by copyrights, trademarks, service marks, international treaties, and/or other proprietary rights and laws. The Content is also protected as a collective work or compilation under copyright and other laws and treaties. All individual articles, columns, and other elements making up the Content on the Site are also copyrighted works. By continuing to access, link to, or use the Site, Content, or Services, Users:

  1. Agree to abide by all applicable intellectual property rights and laws, including copyright, involving the Site, Content, or Services;
  2. Agree to abide by any copyright notices or restrictions contained in the Site, Content, or Services;
  3. Acknowledge that the Content has been developed, compiled, prepared, revised, selected, and arranged by Front Page, and others, through the expenditure of substantial time, effort, and money;
  4. Acknowledge that the Site, Content, and Services constitutes valuable intellectual property of Front Page, and others;
  5. Agree to protect the proprietary rights of Front Page and all others having rights in the Site, Content, and Services, both during and after the term of this agreement;
  6. Agree to comply with all reasonable written requests made by Front Page, and to protect Front Page’s, and others’, contractual, statutory, and common law rights in the Site, Content, and Services;
  7. Agree to notify Front Page, promptly and in writing, upon becoming aware of any unauthorized access or use of the Site, Content, or Services;
  8. Agree to notify Front Page, promptly and in writing, upon becoming aware of any claim that the Site, Content, or Services infringe any copyright, trademark, or other contractual, statutory, or common law rights;
  9. Acknowledge that, as between Users and Front Page, all Intellectual Property Rights Front Page may have relating to the Site, Content, and Services shall at all times be and remain the sole and exclusive property of Front Page;
  10. Acknowledge that all present and future rights to the Site, Content, and Services, including the right to exploit the Content and any portions of the Content over any present or future technology, are reserved to Front Page for its exclusive use;
  11. Agree to not copy or make any use of the Site, Content, or Services, or any portion thereof, except as specifically permitted in the TOS;
  12. Agree to not use the Intellectual Property Rights relating to the Site, Content, or Services; the Content or any variations or derivatives thereof; or the names of any individual participant in, or contributor to, the Site, Content, or Services for any purpose without prior written approval from Front Page, except as specifically permitted in the TOS.
  • Restrictions on Use of Content and Intellectual Property

Users agree to use the Site, Content, and Services solely for their own non-commercial use and benefit. Users agree to not use, distribute, or transfer the Content for the use or benefit of any other person or entity. Users agree to not use, distribute, or transfer the Content in any manner that could compete with the business of Front Page.

Users may not copy, reproduce, distribute, recompile, decompile, disassemble, reverse engineer, distribute, publish, display, perform, modify, upload to, prepare derivative works from, transmit, or in any way exploit any part of the Content, except that Users may download or print copies of the Content for personal and non-commercial use, provided the User retains all copyright and other proprietary notices. Users may not recirculate, redistribute, or publish the Content without Front Page’s prior written consent, except that Users may use the “share” Service solely to inform others about Front Page Content through the linked social media tools and functions. Upon notice from a recipient of Front Page Content via the “share” Service that the recipient does not wish to receive such Content, Users shall immediately cease using the “share” Service with regard that recipient.

Users may not offer any part of the Site, Content, or Services for sale or distribute it over any other medium without the prior written consent of Front Page. Such distribution includes, but is not limited to, hyperlinking or framing the Site, Content, or Services. Please see Section III of the TOS, Linking and Framing Terms and Conditions, for more information.

Users may not use any of the trademarks, trade names, service marks, copyrights, or logos of Front Page in any manner which creates the impression that such items belong to or are associated with Users. Users may not use any of the trademarks, trade names, service marks, copyrights, or logos of Front page in any manner which creates the impression that Front Page has given Users consent to use such items. Users acknowledge that they have no ownership rights to any such items.

The Site, Content, and Services may not be used to construct a database of any kind. Nor may the Content be reproduced, distributed, or stored, in whole or in part, in databases for access by Users or any Third Party.

Users may not input, distribute, upload, post, email, transmit, or otherwise make available any portion of the Site, Content, or Services that:

  1. Is promotional in nature, including solicitations for funds or business, without the prior written authorization of Front Page;
  2. Constitutes junk mail, spam, chain letters, pyramid schemes, or the like;
  3. Is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, hateful, or otherwise objectionable;
  4. Users do not have the right to make available under any law, contract, or fiduciary relationship, including, but not limited to: inside information, proprietary and confidential information, information learned or disclosed during the course of an employment, or information subject to a nondisclosure agreement;
  5. Infringes any patent, trademark, trade secret, copyright, or other proprietary right of any person or entity;
  6. Contains software viruses or any other computer code, file, or program designed to interrupt, destroy, or limit the functionality of any computer software, hardware, or telecommunication network or equipment;
  7. Is harmful to minors; or
  8. Constitutes the personally identifiable information of any other person, unless such person has authorized the disclosure.
  • Rights and Licenses

Users acquire absolutely no rights or licenses to the Content other than the limited right to utilize the Content in accordance with the TOS.

Should a User choose to download Content from the Site, the User must do so in accordance with the TOS. Front Page hereby grants Users a license to use such downloads ONLY for the Users’ own personal, non-commercial use, in accordance with the TOS. Front Page does not transfer any other rights to Users.

Unless Front Page indicates otherwise, if a User submits content to the Site, the User grants Front Page a perpetual, nonexclusive, irrevocable, fully paid, royalty-free, sub-licensable, and transferrable (in whole or in part) worldwide right and license in any and all media, now known or later developed, to use, publish, reproduce, display, modify, transmit, prepare derivative works based upon, distribute, copy, and otherwise exploit such User-submitted content for any purpose whatsoever without additional notice, attribution, or consideration to the User or to any other person or entity. Users also permit any other User to access, store, or reproduce such content for that User’s personal use. Users grant Front Page the right to use the name that the User submitted in connection with such content. Users represent and warrant that they own or otherwise control all rights to the content that they submit; that the content and associated information they submit is truthful and accurate; that use of the content they supply does not violate this TOS and will not cause injury to any person or entity; and that they will indemnify Front Page for all claims resulting from content they supply.

Front Page disclaims any responsibility and assumes no liability for any content submitted by Users or any Third Party.

  • User Accounts, Registration, and Termination

Users may be required to register with the Site to obtain access to certain portions of the Site, Contents, and Services. To register with the Site, Users must select a username and a password. Additionally, Users must provide Front Page with certain registration information, all of which must be accurate, truthful, and updated. Front Page reserves the right to refuse to create an account, or revoke an account, if Front Page is unable to verify the authenticity of the submitted registration information. In registering with the Site, Users shall not:

  1. Select a username already in use by another User;
  2. Select a username to which another person or Third Party has rights, unless the User has authorization from such person or Third Party; or
  3. Select a username or password that Front Page, in its sole discretion, deems offensive or inappropriate.

Users shall be solely responsible for maintaining the confidentiality of their password. If a User knows or suspects that their account has been subject to unauthorized use, the User must immediately notify Front Page of all relevant details including, but not limited to, any known or suspected breach of security, including loss, theft, or unauthorized disclosure of password or other sensitive information. Such information should be submitted via email to info-ir@frontpage.org.

Users are fully responsible for all use and activity associated with their accounts, including, but not limited to, use of the account by any Third Party. If the computer system or device on which a User accessed the Site, Content, or Services is sold or transferred to a Third Party, Users represent and warrant that they will delete all cookies and software files obtained by or through use of the Site, Content, or Services. Notwithstanding anything else herein, Front Page reserves the right to pursue all claims against any Third Parties that utilize a User’s account.

Front Page reserves the right to terminate an account, at its sole discretion, at any time, without notice. Users may terminate their account at any time by submitting a request via email to info-ir@frontpage.org. Upon termination, Users will receive an automated confirmation that the request was received, and the account will be terminated within five (5) business days.

Users agree to maintain only one account with the Site, and certify that they currently have no other account(s) with the Site.

It is strictly prohibited for a User to allow an individual under the age of thirteen (13) years old to use and access their account.

  • Communications from Front Page.org Regarding User Accounts

Front Page reserves the right to communicate with Users regarding their accounts and changes to the Site’s TOS and Privacy Policy. Such communications will be sent via email from a Front Page.org email address.

Front Page will NEVER request User account information via email. If a User has received an email, purporting to be from Front Page, that requests the User’s account information, that email is NOT from Front Page.

Users should forward any suspicious emails purporting to be from Front Page to info-ir@frontpage.org. While Front Page appreciates Users’ cooperation in this matter, ultimately, Front Page is not responsible for any Third Party emails, regardless of whether such emails purport to be from Front Page. Users are responsible for securing their own account information, email addresses, electronic devices, and computer networks.

  • Disclaimer and Limitation of Liability
USERS AGREE THAT THEIR USE OF THE SITE IS AT THEIR SOLE RISK AND ACKNOWLEDGE THAT THE SITE, AND ANYTHING CONTAINED WITHIN THE SITE, INCLUDING, BUT NOT LIMITED TO, CONTENT, SERVICES, GOODS, OR ADVERTISEMENTS, ARE PROVIDED “AS IS” AND “AS AVAILABLE.” USERS UNDERSTAND AND AGREE THAT FRONT PAGE MAKES NO WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE SITE, CONTENT, AND SERVICES, INCLUDING, BUT NOT LIMITED TO, MERCHANTABILITY, NON-INFRINGEMENT, TITLE, OR FITNESS FOR A PARTICULAR PURPOSE.

Front Page does not warrant that the Site, Content, or Services is compatible with any particular computer system or technology environment.

Front Page does not warrant that the Site, Content, or Services, including, but not limited to, any communications sent by Front Page, is free of errors, viruses, works, “Trojan horses,” or any other harmful, invasive, or corrupted files. Front Page is not liable for any damage Users may suffer as a result of such destructive features.

Users agree that Front Page shall have no responsibility or liability for:

  1. Any injury or damages caused by the negligence of Front Page or arising in connection with the Site, Contents, or Services;
  2. Any lost profits, losses, punitive, incidental, or consequential damages; or
  3. Any fault, inaccuracy, omission, delay, or any other failure in the Site, Content, or Services, caused by Users’ computer systems or devices or arising from Users’ use of the Site, Content, or Services on such systems or devices.

Front Page does not maintain or control Third Party websites, services, goods, or advertisements that may be referenced in, linked to, or advertised on, the Site, Content, and Services. Users agree that Front Page is not responsible for the availability, content, or accuracy of such Third Party websites, services, goods, or advertisements.

Front Page does not:

  1. Make any warranty, express or implied, with respect to the use of the links provided on the Site, Content, and Services;
  2. Make any warranty, express or implied, with respect to the use of any links to the Site, Content, and Services;
  3. Guarantee the accuracy, completeness, usefulness, or adequacy of any Third Party websites, services, goods, or advertisements that may be linked to the Site, Content, or Services; or
  4. Make any endorsement, express or implied, of any Third Party websites, services, goods, or advertisements that may be linked to the Site, Content, or Services.

Front Page is not responsible for the reliability or continued availability of telephone lines, wireless services, communications media, telecommunications networks, and any equipment or devices that Users utilize to access the Site, Content, or Services. Users understand that, under the TOS, Front Page and Third Party contributors to the Site, Content, or Services may choose at any time to inhibit or prohibit certain Content from being accessed.

Users acknowledge that:

  1. The Site, Content, and Services are provided for information purposes only;
  2. The Site, Content, and Services may include certain information taken from sources around the world;
  3. Front Page does not guarantee the sequence, accuracy, completeness, or timeliness of the Site, Content, and Services;
  4. The provision of certain parts of the Site, Content, and Services is subject to the terms and conditions of other agreements to which Front Page.org is a party;
  5. No information contained in the Site, Content, and Services constitutes a solicitation, offer, opinion, or recommendation by Front Page;
  6. The information provided on the Site, Content, and Services is not intended for use by, or distribution to, any person or entity in any jurisdiction or country where such use or distribution would be contrary to the law or regulation.

Accordingly, notwithstanding anything set forth herein to the contrary, Front Page shall not be in any way liable, directly or indirectly, to any User or Third Party for any inaccuracies, errors, or omissions in the Site, Content, or Services; for any delays, errors, or interruptions in the transmission or delivery of the Site, Content, or Services; or any loss or damage arising therefrom or occasioned thereby, or by any reason of nonperformance.

UNDER NO CIRCUMSTANCES, INCLUDING WITHOUT LIMITATION NEGLIGENCE, SHALL FRONT PAGE BE LIABLE TO USERS FOR DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES, EVEN IF FRONT PAGE HAS BEEN ADVISED SPECIFICALLY OF THE POSSIBILITY OF SUCH DAMAGES, ARISING FROM THE USE OF, OR INABILITY TO USE, THE SITE, CONTENT, OR SERVICES, OR ANY LINKS OR ITEMS ON THE SITE, CONTENT, OR SERVICES, OR ANY PROVISION OF THE TOS SUCH AS, BUT NOT LIMITED TO, LOSS OF REVENUE, ANTICIPATED PROFITS, OR LOST BUSINSES. APPLICABLE LAW MAY NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. IN NO EVENT SHALL FRONT PAGE’S TOTAL LIABILITY TO A USER FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION (WHETHER IN CONTRACT OR TORT, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE) EXCEED THE AMOUNT PAID BY THE USER, IF ANY, FOR ACCESSING THE SITE.
  • Indemnification

Users agree, at their own expense, to indemnify, defend, and hold harmless Front Page from and against all Third Party claims, damages, liabilities, costs, and expenses, including reasonable attorneys’ and experts’ fees, arising from, or in connection with, Users activities involving the Site, Content, and Services, including, but not limited to:

  1. A User’s use of the Site, Content, or Services;
  2. Use of the Site, Content, or Services via a User’s system, devices, or account, with or without the User’s permission;
  3. Any violations of the TOS by a User;
  4. Any violations of the TOS by Third Parties using the User’s system, devices, or account, with or without the User’s permission;
  5. Any claims that use of the Site, Content, or Services by a User, or by someone using the User’s system, devices, or account, infringes the intellectual property rights of any Third Party;
  6. Any claims that use of the Site, Content, or Services by a User, or by someone using the User’s system, devices, or account, violates any right of privacy or publication, is libelous or defamatory, or otherwise results in injury or damage to any Third Party;
  7. Any deletions, additions, insertions, alterations to, or unauthorized use of the Site, Content, or Services by a User, or someone using the User’s system, devices, or account;
  8. Any misrepresentation or breach of a representation or warranty made by a User herein; or
  9. Any breach of any covenant or agreement to be performed by a User hereunder.

Users agree to pay all costs, damages, and expenses, including, but not limited to, reasonable attorneys’ fees and costs awarded for or arising from any suit, action, or proceeding involving Third Parties that are attributable to such claims.

Front Page reserves the right, at its own expense, to assume the exclusive defense and control of any Third Party matter otherwise subject to indemnification by a User. In the event Front Page assumes such control, Users will fully cooperate with Front Page in asserting any available defense.

Users agree to pay the reasonable attorneys’ fees that Front Page incurs in connection with all Third Party lawsuits brought against Users by Front Page that involve alleged breach of the TOS, Privacy Policy, or any other terms and conditions of the Site. This includes, without limitation, lawsuits arising from the failure to indemnify Front Page pursuant to the TOS.

  • Exports & Foreign Assets Statement

Front Page does not represent that the Site, Content, or Services are appropriate for use in any particular country, region, or geographic location. Those who choose to access the Site, Content, or Services do so on their own initiative and are responsible for compliance with all applicable laws. By downloading or using the Site, Content, or Services, Users represent and warrant that they are not (a) located in, or a national or resident of, any country subject to British Virgin Islands trade sanctions, (b) on any British Virgin Islands Prohibited Party List, or (c) acting on behalf of any person or entity on any such list.

  • Miscellaneous

Users accept that Front Page has the right to change the Site, Content, or Services, or the technical specifications of any aspect of the Site, Content or Services, any time and in Front Page’s sole discretion. Users further accept that such changes may result in their being unable to access the Site, Content, or Services.

The failure of Front Page to exercise or enforce any right or provision of the TOS shall not constitute a waiver of such right or provision.

Sections II.A-C, E-K, and M-Q shall survive any termination of the TOS.

  • Governing Law

The TOS shall be governed and construed in accordance with the laws of the British Virgin Islands, without giving effect to the conflicts of law principles thereof.

  • Disputes

Any dispute or claim arising out of or relating to this TOS (a “Dispute”) that is not resolved within thirty (30) days after any party gives the other party formal written notice that a Dispute exists between them, is to be resolved exclusively and finally by confidential arbitration conducted in accordance with this Section. The arbitration shall be conducted using the United Nations Commission on International Trade Law (“UNCITRAL”) Arbitration Rules by one arbitrator fluent in English appointed in accordance with the UNCITRAL Arbitration Rules. The arbitrator shall issue its award in accordance with the applicable law governing this TOS, but follow the UNCITRAL Arbitration Rules in all respects that are not explicitly governed by the rules set forth in this Section (which control if they conflict with the UNCITRAL Arbitration Rules).

The arbitrator shall be (1) a lawyer admitted to practice in a jurisdiction in the United States of America (2) experienced in arbitrating commercial disputes, and (3) unless the Parties to the arbitration consent otherwise, selected in accordance with the UNCITRAL Arbitration Rules. The arbitration shall take place in the State of Delaware in the United States of America. In addition, the following shall apply to the arbitration:

  1. the arbitration shall be conducted in English and in any other language that a Party to the arbitration may request; provided, however, that the expense of conducting the arbitration in such additional language shall be borne solely by the Party requesting the same;
  2. the decision of the arbitrator shall be rendered as expeditiously as possible within the term contemplated by the UNCITRAL Arbitration Rules; provided, however, that any arbitrator is hereby authorized to extend the duration of the arbitration beyond such term for cause without the prior consent of the Parties;
  3. the award of the arbitrator shall be final and binding, and shall not be subject to further judicial review (and the award shall be in writing and in English);
  4. the arbitrator shall neither have nor exercise any power to award special, exemplary, indirect, consequential, punitive, or similar damages;
  5. the arbitrator’s decisions may be enforced in any court of competent jurisdiction in the jurisdiction in which a Party involved in the Dispute is organized or has offices or is otherwise subject to enforcement in that jurisdiction, and any such court is hereby authorized to enter judgment and enforce the arbitrator’s decisions;
  6. the fees and expenses of the arbitration proceeding, including fees and expenses of the arbitrator, shall be split equally between Front Page and the User; provided, however, that each party shall bear its own costs and attorneys’ fees associated with the arbitration proceeding; and
  7. each Party shall carry out without delay the provisions of any arbitration award or decision.

Arbitration under this Section is the exclusive method for resolving any Dispute, and User shall not commence any action or proceeding based on any Dispute, except to enforce an arbitrator’s decision as provided in this Section or to compel participation in arbitration.

  • Headings

The section titles in the TOS are used solely for the convenience of Users and Front Page, and have no legal or contractual significance.

  • Severability

If any provision of the TOS is found invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the other provisions of the TOS will remain in force.

  • Entire Agreement

The TOS, Privacy Policy, and any other terms and conditions of service on the Site constitute the entire agreement between Users and Front Page and govern the use of the Site, Content, and Services.

 

3. Linking and Framing Terms and Conditions

USERS MAY NOT LINK TO OR FRAME THIS SITE, OR ANY PORTION THEREOF, EXCEPT AS PROVIDED HEREIN.

  • Intellectual Property

Upon linking to the Site, Content, or Services, pursuant to the TOS, Users will be granted a non-exclusive, non-transferrable, royalty-free sub-license to use the Front Page mark, owned by Front Page, solely for providing an underlined, textual link from Users’ website to the Site.   • Restrictions on Linking to the Site

Without limiting other provisions of the TOS, Users may include a link on their websites to Front Page’s publicly accessible Site pages (i.e., any Site page which does not require a login and password and/or restrict access in another manner). Users may not link to the Site any website containing an inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful topic, name, material or information that violates any applicable intellectual property, proprietary, privacy or publicity rights.

  • Restrictions on Framing Activities

Front Page is concerned about the integrity of the Site when it is accessed in a manner solely determined by Third Parties or viewed in a setting solely created by Third Parties. Specifically, Front Page is concerned with activities such as bringing up or presenting Content within another website (“framing”). In this regard, and without limiting the provisions of the TOS, Users may not frame any webpage from the Site except with Front Page’s express written permission. Further, Users may not archive, cache, or mirror any Site pages or portions of a Site page.     To be effective, a Claim must be in writing, sent to the Designated Agent at the address provided above, and must include the following information: 

    • A physical or electronic signature of the Claimant or any other person authorized to act on behalf of the Content Owner of an exclusive right that is allegedly infringed,
    • Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single Claim, a representative list of such works,

    Upon the Designated Agent’s receipt of a proper Claim, so long as such information is sufficiently clear and specific as to actionable, Front Page will:

    • Promptly contact the Claimant or the person authorized to act for the Content Owner,
    • Seek expeditiously to remove or disable access to the Content claimed to be infringing or the subject of infringing activity,
    • Notify the Content Owner of the Claim, that Front Page has removed or disabled access to its Content and provide such person with the right to provide a counter-notice to the Designated Agent (“Counter-Notice”), and

    Upon receipt of a Counter-Notice, promptly provide the Claimant with a copy of the Counter-Notice and, at its option, Front Page may inform the Claimant that Front Page will replace the removed Content or cease disabling access thereto from 10-14 business days after receipt of the Counter-Notice unless the Designated Agent receives notice and objective evidence that Claimant (or the authorized person) has filed a court action seeking to restrain the Content Owner from engaging in infringing activity on or through the Site.

    To be effective, a Counter-Notice must be in writing and must contain the all or substantially all of the following information from the Content Owner or other authorized person:

    • A physical or electronic signature of the Content Owner,

    Under the DMCA, any person who knowingly and materially misrepresents that any Content or activity is infringing, or that any Content or activity was removed or disabled by mistake or misidentification, shall be liable for any damages (including costs and attorneys’ fees) incurred by the alleged infringer or by Front Page in responding or taking the actions outlined herein in reliance upon such material misrepresentations. Front Page may restrict access to this site, at its sole discretion, for any User who is a repeat violator of this policy or a repeat infringer of the rights of Content Owners.

    B. Use of Information from Visitors

    Information collected from Visitors is used for purposes of internal reviews, including, but not limited to: traffic audits; tailoring the Site’s pages to a particular User’s technology environment; tailoring the Site’s Content and Services to a particular User’s preferences; generating Content and Services recommendations; generating and analyzing aggregate demographic information, Site traffic, and search trends; and general Site administration. Utilizing User data in the manners outlined above allows Front Page to create a Site experience that better addresses the needs and preferences of its Users. The information the Site collects is also used for important Site administration purposes and for internal reviews.

    At this time, Front Page does not share the non-personally identifiable information it collects from Visitors with any Third Parties. However, Front Page may exercise the right to disclose such non-personally identifying information in an aggregate, anonymized form at a future date, with notice consistent with section 3.H Privacy Policy Modifications. Additionally, Front Page may exercise the right to disclose any analysis it performs on such information, though not the information itself, for the purposes of obtaining sponsors, selling advertising space, or for any other legitimate purpose. Should Front Page decide to disclose such information to Third Parties, Front Page will do so in accordance with all relevant national and international laws.

     

    2. Personally Identifiable Information

    A. Information Collected from Users

    Front Page passively or automatically collects the Internet Protocol (IP) addresses of Site Visitors. However, Front Page does not passively or automatically collect or retain geolocation information relating to IP addresses. Front Page does collect and retain such region or geolocation information, or language preferences, that a User might self-select upon visiting the Site.

    Additionally, Front Page collects and retain such personally identifiable information that a User might choose to provide. Such information may include, but is not limited to:

    1. The User’s language preferences;
    2. The User’s region or geolocation;
    3. The User’s name, username, or pseudonym;
    4. The User’s email address, or other contact information;
    5. The User’s log-in credentials, should the User choose to register with the Site;

    Front Page does not require Users to register with the Site to view Site Contents. Front Page may require User’s to register with the Site before they can utilize certain Services.

    B. Use of Information from Users

    Front Page collects such personally-identifiable or sensitive information of Site Users, as identified above, to facilitate and improve Users’ interactions with Site Content and Services. User-selected region or geolocation information and language preferences allow Front Page to enhance a Users’ experiences with the Site by tailoring Content and Services to Users’ interests.

    Additionally, Front Page uses the passively or automatically collected IP addresses of Users for identity, safety, and security purposes. Such uses include, but are not limited to, identifying a specific User, investigating or preventing a User’s abuse of any and all terms of the Site, or preventing access to the Site based on a User’s IP address.

    If a User chooses to register with the Site, Front Page utilizes any User-provided information to track the User’s Content and Services history; suggest Content or Services; track, remember, and apply a User’s desired Content, Services, or account settings; or otherwise augment or improve the User’s experience with Site Contents or Services. Front Page also utilizes such information or for purposes of Site administration and internal review.

    Front Page maintains a historical record for each registered User. This historical record may include, but is not limited to, the User’s: account history, Site activities, previously-accessed Content, previously-requested Services, and any related data. Front Page may use this data to help identify potential liabilities, resolve disputes, troubleshoot problems, or enforce all terms of the Site. These data sets cannot be completely removed for any reason, including User request.

    If a User has chosen to provide contact information to Front Page, Front Page may use such information to communicate with the User, including, but not limited to: sending the User occasional messages, Content, or communications; corresponding with the User in response to the User’s inquiries; providing Services at the User’s request; and otherwise managing the User’s account. Users may opt-out of future promotional mailings from Front Page by employing the methods provided in Section 3.G Opt-Out and Modification of Provided Information. However, even where a User chooses to opt-out from promotional mailings, registered Users will continue to receive administrative messages or communications related to the User’s account or to the usage and functionality of the Site.

    At this time, Front Page does not share the personally identifiable or sensitive information it collects with Third Parties.

    C. Registration by Children is Prohibited

    Pursuant to Front Page’s Terms of Service, only users thirteen (13) years and older may register for an account with the Site. Front Page generally does not knowingly collect personally identifiable information from children under thirteen (13) years of age. Upon notice that Front Page has inadvertently collected personally identifiable information from a child under thirteen (13) years of age, Front Page will take all reasonable steps to remove such information from its records as quickly as reasonably possible. Please contact Front Page at info-ir@frontpage.org to report any such violations of Front Page’s Terms of Service and to facilitate removal of such information, pursuant to Front Page’s Privacy Policy.

         

    3. Additional Terms

    A. Security

    Front Page employs commercially reasonable security methods to secure the privacy of Site Users, including, but not limited to, password protected file systems and similar means of protection, designed to protect against the loss, misuse, and alteration of information under our control. While Front Page take commercially reasonable security precautions, Front Page is not responsible for data breaches of Third Parties such as, but not limited to: web hosts; advertising providers; communications providers; any Third Parties accessible via the Site through methods such as, but not limited to, hyperlinks, referral links, or reference; or any Third Parties a User might utilize to interact with Site Content, such as, but not limited to, social media or other Content sharing or communication platforms.

    B. Voluntary Public Disclosure

    The Site’s Services may include features such as, but not limited to, User profiles, User-generated reading lists, and Content-sharing Services. Any information a User discloses in these areas may be publicly available on the Internet. Such information may be read, collected, or used by Third Parties. Front Page is not responsible for personally identifiable information a User may choose to publicly disclose.

    To the extent that Users post any personal Content, such as pictures, video, or other intellectual property Users may own on the Site, Users understand and agree that Front Page shall have an absolute license and right to use, copy, distribute, or otherwise display the Content the Users provided on the Site, as well as Third Party sites with whom Front Page may have agreements.

    C. Third Party Websites

    This Policy applies only to the information collected by Front Page. The Site may contain links, references, or Content-sharing Services to other Third Party websites, or involving other Third Party websites, that are not owned or controlled by Front Page. These sites control their own privacy practices and are not bound by this Policy. Front Page is not responsible for the information or services provided on Third Party sites, nor is it responsible for the privacy practices or content of such sites.
